1. Introduction

Welcome to SilvaCreate Digital Agency. These Terms and Conditions govern your use of our services, including web design, software development, digital marketing, managed web hosting, and reseller web hosting. By engaging with our services, you agree to be bound by these terms. Please read them carefully.

2. Services Overview

SilvaCreate Digital Agency provides the following services:

Web Design & Software Development: We create custom websites and software tailored to meet your business needs.
Digital Marketing: We offer a range of digital marketing services, including SEO, social media marketing, and content marketing.
Managed Web Hosting & Reseller Hosting: We provide reliable hosting services to ensure your website runs smoothly.

3. Payment Terms

Web Design & Software Development: A 70% deposit is required before project commencement. The remaining 30% is due upon project completion and approval by the client. Deployment will only occur after full payment is received.
Hosting & Digital Marketing: Payment is required upfront for the duration of the service. Invoices will be provided, and services will commence upon receipt of payment.

4. Project Timelines

Timelines for each project are determined individually after the discovery phase is completed. We will provide you with a detailed proposal outlining the cost, timeline, technology stack, and any other considerations such as hosting. If delays occur from either the client’s side or ours, we will communicate promptly to explain the impact and provide a revised timeline.

5. Client Requirements

Client requirements are assessed on a project-by-project basis. We will work closely with you to understand your needs and ensure that the final product aligns with your expectations.

6. Revisions

We offer unlimited revisions for reasonable requests. Our goal is to ensure that you are completely satisfied with the final product.

7. Refund Policy

Refunds are generally not provided once a project is completed. However, if a project is cancelled midway, we will charge for the work completed up to that point and refund any remaining balance.

8. Intellectual Property

Upon full payment and fulfilment of all obligations, the client will own the intellectual property rights to the work produced, unless otherwise stated in a separate agreement.

9. Hosting Services

Our hosting services are governed by a strict anti-spam policy. We enforce a 3-strike policy for violations:

First Strike: Warning and temporary suspension of the account.
Second Strike: Extended suspension and review of the account.
Third Strike: Termination of the account without refund.

We are committed to maintaining a clean and secure hosting environment for all our clients.

10. Legal Compliance

These terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these terms or the use of our services will be subject to the jurisdiction of Nigerian courts.
